1. General provisions
1.1. The My Media Library Bot project (hereinafter referred to as the "Media Bot") offers the Internet user (hereinafter referred to as the User) to use its services on the terms set out in this User Agreement (hereinafter referred to as the "Agreement", "PS"). The Agreement comes into force from the moment the User expresses consent to its terms in accordance with the procedure provided for in clause 1.4 of the Agreement.
1.2. The Media Bot offers Users access to a wide range of services, including means of communication, search, placement and storage of various kinds of information and materials (content), personalization of content, shopping, etc. All currently existing services of the Media Bot project, the terms of use of which refer to this Agreement, as well as any development and/or addition of new ones, are the subject of this Agreement.1.3. The use of the Media Bot services is governed by this Agreement, as well as the following documents, which are an integral part of this agreement: Privacy Policy (https://mymedialib.space/privacy-policy ), as well as the terms of use of individual services. The Agreement may be amended by the administration of the Media Bot without any special notice, the new version of the Agreement comes into force from the moment it is posted on the Internet at the address specified in this paragraph, unless otherwise provided by the new version of the Agreement. The current version of the PS is always on the page at https://mymedialib.space/user-agreement .
1.4. Starting to use any service/its individual functions, or going through the registration procedure, the User is considered to have accepted the terms of the Agreement in full, without any reservations and exceptions. If the User does not agree with any of the provisions of the Agreement, the User does not have the right to use the services of the Media Bot. If the Administration of the Media Bot has made any changes to the Agreement in accordance with paragraph 1.3 of the Agreement, with which the User does not agree, he is obliged to stop using the services of the Media Bot.
2. User Registration. User Account
2.1. In order to use some of the Media Bot services or some of the individual functions of the services, the User must complete the registration procedure (After clicking the "Start" button to add information about himself), as a result of which a unique account will be created for the User. A user who has reached the age of 16 has the right to independently register an account and use the services of a Media Bot within the legal capacity established by applicable law. If the User has not reached the specified age, as well as in cases where applicable law requires it, the use of the services is allowed only with the consent of parents or other legal representatives. Individual Media Bot services may set other age restrictions, which may additionally be indicated in legal documents or in the interface/description of the site, application and/or bot and/or other software product.
2.2. In order to register, the User undertakes to provide reliable and complete information about himself on the issues proposed in the registration form and to keep this information up to date. If the User provides incorrect information or the Administration of the Media Bot has reason to believe that the information provided by the User is incomplete or unreliable, the Administration of the Media Bot has the right, at its discretion, to block or delete the User's account and refuse the User to use its services (or their individual functions).
2.2.1. Upon registration, the User can upload an image for the account (avatar), as well as set up a name that can accompany the materials published by the User as part of using the Media Bot services, including comments, reviews, etc. (User Name).
If the user has not set up a Username, it will be displayed in the format: first and last name specified by the User in the Telegram account.
The Account image and User Name must comply with the requirements of Section 4 of this Agreement.
2.2.2. The User understands and agrees that the account image and User Name may accompany the materials published by the User as part of the use of the Media Bot services and will be available to an unlimited number of people. The User agrees that the Administration of the Media Bot has the right to display the account image and User Name in the Media Bot services, in advertising products, corporate blogs and Media Bot accounts on third-party resources.
The account image, User Name and other information uploaded by the User, published by the User and available in the Media Bot services, specified by the User, must be displayed to an unlimited number of people solely for the purpose of providing the appropriate Media Bot service and personalization of Users. This information (including including personal data) is not intended for its collection and further dissemination by third parties, except in cases where such purpose is expressly specified in the terms of the relevant service.
2.3. Account confirmation
2.3.1. The Administration of the Media Bot reserves the right at any time to require the User to confirm the data specified during registration in the User's account on the Media Bot services (including data from the Linked card or wallet of the payment system or exchanger) and containing information about the User, as well as other information related to the use of the services A Media Bot that is available to the User after the User has logged in to the services of the Media Bot (its affiliates).
2.3.2. For the purpose of verifying the data declared by the User, the administration of the Media Bot has the right to request supporting documents (in particular, identity documents), the failure of which, at the discretion of the Media Bot, may be equated to providing false information and entail the consequences provided for in clause 2.2 of the Agreement. If the User's data specified in the documents provided by him does not correspond to the data specified during registration, as well as in the case when the data specified during registration does not allow identification of the User, the Administration of the Media Bot has the right to deny the User access to the account and use of the Media Bot services.
2.3.3. In some cases, the Administration of the Media Bot may provide the User with the opportunity to obtain the status of a verified account. To complete the verification procedure, the account must be confirmed using a mobile phone and/or e-mail, comply with the terms of this Agreement and the rules posted on the Account Verification page.
The necessary information is provided by the User in accordance with clause 2.2. of this Agreement and in the format provided for by the rules Account verification, taking into account the list of requested documents specified in the rules. The list of necessary information for account verification can be changed at the discretion of the Administration of the Media Bot.
2.3.3.1. Based on the results of verification of the provided information and supporting documents, the User can receive a unique badge of the verified account. In case of non-compliance of the information provided with the terms of clauses 2.2., 2.3 of this Agreement, submission of false or misleading information, violation of the terms of this Agreement, the Media Bot Administration reserves the right to delete the verification mark or the User account in accordance with clause 2.10.2 of this Agreement.
2.4. The User's personal information defined by the Privacy Policy and contained in the User's account is stored and processed by the Administration of the Media Bot in accordance with the terms of the Privacy Policy (https://mymedialib.space/privacy-policy ).
2.5. Means to access the User's account.
2.5.1. When registering in the Media Bot, the user transmits with the first message the data about his Profile, which is accepted by the Media bot. At the same time, the User can independently change the login (the unique symbolic name of the User account) used by him and configured in third-party services (for example, Telegram), through which the Media Bot can provide access to its Services.
The administration of the Media Bot has the right to prohibit the use of certain logins, as well as to set login requirements (length, allowed characters, etc.). For certain tools, the Administration of the Media Bot can generate one-time passwords in order to provide access to the functions of the service.
The user has the right to use an alternative authorization tool selected by him from the options offered in the authorization form, including using accounts of third-party resources. By choosing an alternative authorization tool, the User agrees to receive User data from third-party information resources under the terms of the Privacy Policy (https://mymedialib.space/privacy-policy ). The user is obliged to independently control the reliability of the means of access to a third-party resource chosen by him and the safety of credentials.
2.5.1.1. The User may be given the opportunity to complete a simplified account registration procedure by clicking the "Start" button, without filling in personal data.
The use of individual services and/or individual functions of the Media Bot services using an account created in a simplified manner may not be available. To use the functionality of the Media Bot services in full, the User may need to fill in the necessary fields in the account in accordance with the procedure established in clause 2.5.1 of the Agreement.
2.6. The User is solely responsible for the security (including resistance to guessing) of the means chosen by him to access the account, and also independently ensures their confidentiality. The User is solely responsible for all actions (as well as their consequences) within or using the Media Bot services under the User's account, including cases of voluntary transfer by the User of data for access to the User's account to third parties on any terms (including contracts or agreements). At the same time, all actions within or using the Media Bot services under the User account are considered to be performed by the User himself, except in cases when the User, in accordance with the procedure provided for in clause 2.7., notified the Administration of the Media Bot about unauthorized access to the Media Bot services using the User account and/or about any violation (suspicion of violation) of the confidentiality of their account access means (mobile phone number, password, or two-factor authentication means).
2.7. The User is obliged to immediately notify the Administration of the Media Bot about any case of unauthorized (not authorized by the User) access to the Media Bot services using the User's account and/or about any violation (suspicion of violation) of the confidentiality of their means of access to the account. For security reasons, the User is obliged to independently perform a secure shutdown under his account at the end of each session of working with the Media Bot services. The administration of the Media Bot is not responsible for the possible loss or damage of data, as well as other consequences of any kind that may occur due to a violation by the User of the provisions of this part of the Agreement.
2.8. User's use of their account.
2.8.1. The User does not have the right to reproduce, repeat and copy, sell and resell, as well as use for any commercial purposes any parts of the Media Bot services (including content accessible to the User through the services), or access to them, except in cases where The user has received such permission from the Administration of the Media Bot, or when it is expressly provided for in the user agreement of any service.
2.8.2. Some categories of User accounts may restrict or prohibit the use of certain Media Bot services or their individual functions if this is provided for during registration or in the terms of use of a particular service.
2.9. Termination of registration. The administration of the Media Bot has the right to block or delete the User's account, as well as prohibit access using any account to certain Media Bot services, and delete any content without explanation, including in case of violation by the User of the terms of the Agreement or the terms of other documents provided for in clause 1.3. of the Agreement, as well as in case of non-use of the relevant service.
2.10. Deleting a User account.
2.10.1. The User has the right to delete his account on all Media Bot services at any time or, if there is an appropriate function, terminate it in relation to some of them.
2.10.2. The Media Bot deletes the account in the following order:
2.10.2.1. the account is automatically blocked for a period of one month, during which the User's access to his account becomes impossible, while the content posted using such an account can be deleted;
2.10.2.2. if the User's account is restored by the User within the above period, access to the User's account will be restored, however, the content posted using it may not be recoverable;
2.10.2.3. if the User's account is not restored within the above period, all content posted using it will be automatically deleted, and the login will be available for use by other users. From this moment on, it is impossible to restore the account, any information related to it, as well as access to the Media Bot services using this account.
2.10.3. The procedure given in paragraphs 2.10.2.1., 2.10.2.2., 2.10.2.3. of the Agreement (with the exception of the availability of the login for use by other users) also applies to the prohibition of access using any account to certain services.
3. General provisions on use and storage
3.1. The administration of the Media Bot has the right to set restrictions on the use of the services for all Users, or for certain categories of Users (depending on the User's place of residence, the language in which the service is provided, etc.), including: the presence/absence of certain functions of the service, the shelf life of messages in the Media Bot service, any other content, the maximum number of messages that can be sent or received by one registered user, the maximum number of requests to the service for a specified period of time, the maximum storage period of the content, the size of the disk space, special parameters of the downloaded content, etc. The administration of the Media Bot can prohibit automatic access to its services, as well as stop accepting any information generated automatically (for example, spam).
The administration of the Media Bot, in order to protect the User's equipment and its own equipment, has the right to restrict the reception of any messages and their delivery to the User when such messages contain malware or code, or when automatic filtering and antivirus protection tools of the Media Bot have determined the presence of such malware or codes in the specified messages. The User is notified and agrees that the Administration of the Media Bot, for the specified purposes, has the right to analyze and investigate such malware and codes contained in these messages in order to improve the quality of the automatic filtering tools and antivirus protection of the Media Bot.
3.2. The administration of the Media Bot has the right to send information messages to the User. The administration of the Media Bot also has the right to send advertising messages to the User, provided that consent is obtained in a manner that meets the requirements of the law, or provided that the User has not refused to receive advertising messages in relation to the relevant service (during registration, or later using the appropriate functionality).
The User agrees with the Administration of the Media Bot to notify other Users of the Service about the User's public actions, including the posting of new publications, actions performed by him in relation to the Content of other Users, as well as other activities performed by him within the framework of the Service.
3.3. In order to improve the quality of the services, the Media Bot and/or the persons involved in conducting the survey have the right to collect opinions and feedback from Users on various issues by sending an information message at the next visit of the User to the service or by contacting the contact details specified by the User in the account (via phone calls or emails). The collected opinions and reviews can be used to generate statistical data that can be used in the services of the Media Bot. The feedback provided by the User during the survey can also be published by the Administration of the Media Bot in the services of the Media Bot or in the services of persons affiliated with the Media Bot, both with or without specifying the User's name (login). When leaving feedback, the User undertakes to comply with the requirements of this Agreement, including the requirements set out in clause 5 of this Agreement.
4. User Content
4.1. The User is solely responsible for the compliance of the content posted by the User with the requirements of current legislation, including liability to third parties in cases where the User's posting of a particular content or the content of the content violates the rights and legitimate interests of third parties, including the personal non-property rights of the authors, other intellectual rights of third parties, and/or encroaches on intangible benefits belonging to them.
4.2. The User acknowledges and agrees that the Administration of the Media Bot is not obliged to view any kind of content posted and/or distributed by the User through the services of the Media Bot, as well as that the Administration of the Media Bot has the right (but not the obligation) at its sole discretion, to refuse to post and/or distribute content to the User or to remove any content that is available through the services of the Media Bot. The User understands and agrees that he must independently assess all risks associated with the use of content, including evaluating the reliability, completeness or usefulness of this content. 4.3. The User understands and agrees that the technology of the services may require copying (reproduction) of the User's content by a Media Bot, as well as processing it by a Media Bot to meet the technical requirements of a particular service. 4.4. When processing complaints received regarding User content, the Administration of the Media Bot is guided by the principles of Restriction of the rights of anonymous content published at Restrictions on the rights of anonymous content, unless otherwise provided by the terms of use of the service.5. Terms of use of Media Bot services
5.1. The User is solely responsible to third parties for his actions related to the use of the Service, including if such actions lead to violation of the rights and legitimate interests of third parties, as well as for compliance with the law when using the Service.
5.2. When using the Media Bot services, the User does not have the right to:
5.2.1. upload, send, transmit or in any other way post and/or distribute content that is illegal, malicious, defamatory, offends morality, demonstrates (or promotes) violence and cruelty, violates intellectual property rights, promotes hatred and/or discrimination of people on racial, ethnic, sexual, religious, social grounds, contains insults against any persons or organizations, contains elements (or is propaganda) of pornography, child eroticism, it represents advertising (or is propaganda) of sexual services (including under the guise of other services), explains the procedure for the manufacture, use or other use of narcotic substances or their analogues, explosives or other weapons;
5.2.2. violate the rights of third parties, including minors, and/or harm them in any form;
5.2.3. impersonate another person or a representative of an organization and/or community without sufficient rights, including employees of a Media Bot, moderators of forums, the owner of the site, as well as use any other forms and methods of illegal representation of other persons on the network, as well as introduce users or the Administration of the Media-The bot is misleading about the properties and characteristics of any subjects or objects;
5.2.4. upload, send, transmit or in any other way post and/or distribute content, in the absence of rights to such actions under the law or any contractual relationship;
5.2.5. upload, send, transmit or in any other way post and/or distribute advertising information that is not specifically authorized, spam (including search), lists of other people's email addresses, pyramid schemes, multilevel (network) marketing (MLM), Internet earnings systems and e-mail businesses, "letters of happiness", as well as use the services of a Media Bot to participate in these events, or use the services of a Media Bot exclusively to redirect users to pages of other domains;
5.2.6. upload, send, transmit or in any other way post and/or distribute any materials containing viruses or other computer codes, files or programs designed to disrupt, destroy or limit the functionality of any computer or telecommunications equipment or programs for unauthorized access, as well as serial numbers to commercial software products and programs for their generation, logins, passwords and other means to gain unauthorized access to paid resources on the Internet, as well as posting links to the above information;
5.2.7. it is not authorized to collect and store personal data of other persons;
5.2.8. disrupt the normal operation of the websites and services of the Media Bot;
5.2.9. to facilitate actions aimed at violating the restrictions and prohibitions imposed by the Agreement;
5.2.10. otherwise violate the norms of legislation, including the norms of international law.
6. Exclusive rights to the content of the services and content
6.1. All objects accessible using the Media Bot services, including design elements, text, graphics, illustrations, videos, computer programs, databases, music, sounds and other objects (hereinafter referred to as the content of the services), as well as any content hosted on the Media Bot services are the objects of the exclusive rights of the Media Bot Administration, Users and other copyright holders.
6.2. The use of the content, as well as any other elements of the services, is possible only within the framework of the functionality offered by a particular service. No elements of the content of the Media Bot services, as well as any content posted on the Media Bot services, may be used in any other way without the prior permission of the copyright holder. Usage means, among other things: reproduction, copying, processing, distribution on any basis, display in a frame, etc. The exception is cases directly provided for by the legislation or the terms of use of a particular Media Bot service.The User's use of elements of the content of the services, as well as any content for personal non-commercial use, is allowed provided that all copyright, related rights, trademarks, other authorship notices are preserved, the name (or pseudonym) of the author/name of the copyright holder is preserved unchanged, and the corresponding object is preserved unchanged. The exception is cases directly provided for by legislation or user agreements of a particular Media Bot service.
7. Third-party sites and content
7.1. The Media Bot services may contain links to other sites on the Internet (third-party sites). These third parties and their content are not checked by the Administration of the Media Bot for compliance with certain requirements (reliability, completeness, legality, etc.). The administration of the Media Bot is not responsible for any information, materials posted on third-party sites that the User accesses using the services, including for any opinions or statements expressed on third-party sites, advertising, etc., as well as for the availability of such sites or content and the consequences of their use By the user.
7.2. A link (in any form) to any website, product, service, or any information of a commercial or non-commercial nature posted on any service does not constitute an endorsement or recommendation of these products (services, activities) by the Administration of the Media Bot, except in cases where this is explicitly indicated on the resources of the Media Bot.8. Advertising on Media Bot services
8.1. The administration of the Media Bot is responsible for the advertising placed by it on the services of the Media Bot, within the limits established by law.
9. No warranty, limitation of liability
9.1. The User uses the Media Bot services at his own risk. The services are provided "as is". The administration of the Media Bot does not assume any responsibility, including for the compliance of the services with the User's goals;
9.2. The administration of the Media Bot does not guarantee that: the services meet/will meet the User's requirements; the services will be provided continuously, quickly, reliably and error-free; the results that can be obtained using the services will be accurate and reliable and can be used for any purpose for purposes or in any capacity (for example, to establish and/or confirm any facts); the quality of any product, service, information, etc. obtained using the services will meet the User's expectations; 9.3. Any information and/or materials (including downloadable software, emails, any instructions and guides to action, etc.) that the User accesses using the Media Bot services, the User can use at his own risk and independently is responsible for the possible consequences of using the specified information and/or materials, including for the damage that this may cause to the User's computer or to third parties, for data loss or any other harm; 9.4. The Administration of the Media Bot is not responsible for any kind of losses that occurred as a result of the User's use of the Media Bot services or individual parts/functions of the services; 9.5. Under any circumstances, the responsibility of the Media Bot Administration is assigned to it if there is guilt in its actions.10. Other provisions
10.1. This Agreement is an agreement between the User and the Administration of the Media Bot regarding the use of the services and replaces all previous agreements between the User and the Administration of the Media Bot.
10.2. This Agreement is governed by and interpreted in accordance with the law. Issues not regulated by this Agreement are subject to resolution in accordance with the law. All possible disputes arising from the relations regulated by this Agreement shall be resolved in accordance with the procedure established by the current legislation, according to the norms of Russian law. Throughout the text of this Agreement, unless explicitly stated otherwise, the term "legislation" means both the legislation and the legislation of the User's place of residence.
10.3. With regard to services provided free of charge under this Agreement, the rules on consumer protection provided for by law may not be applicable to the relationship between the User and the Administration of the Media Bot.
10.4. If the Media Bot services provide for the possibility of a paid subscription, then in order to subscribe and further pay for the subscription, the User links his bank card to his account (hereinafter referred to as the Linked Card). For the purposes of this Agreement, any bank card linked to the User's account (including those linked when subscribing to the Media Bot services either before or after subscribing) is considered a Linked Card. The procedure for adding and using Linked Cards is governed by the terms published at: (still in development).
10.5. Nothing in the Agreement can be understood as the establishment of agency relations, partnership relations, joint activity relations, personal employment relations, or any other relations not expressly provided for in the Agreement between the User and the Administration of the Media Bot. 10.6. If, for one reason or another, one or more provisions of this Agreement are declared invalid or unenforceable, this does not affect the validity or applicability of the remaining provisions of the Agreement.10.7. Inaction on the part of the Media Bot Administration in case of violation by the User or other users of the provisions of the Agreements does not deprive the Media Bot Administration of the right to take appropriate actions to protect its interests later, and also does not mean that the Media Bot Administration renounces its rights in case of subsequent similar actions or similar violations.
10.8. This Agreement is written in Russian and in some cases may be provided to the User for review in another language. In the event of a discrepancy between the Russian version of the Agreement and the version of the Agreement in another language, the provisions of the Russian version of this Agreement shall apply.
